Terms of Service

These Terms of Service ("Terms") apply to your use of this website and to any purchase of the digital cookbook Emiko's Recipe Book and any related add-ons (together, the "Products"). The website and Products are operated by Lukáš Humhal ("we", "us", "our"). By using this website or buying a Product, you agree to these Terms. If you don't agree, please don't use the website or buy the Products.

1. Who can buy

You must be at least 18 years old, or the age of majority where you live, to make a purchase. By buying, you confirm that the information you give at checkout is accurate and that you are allowed to use the payment method you choose.

2. What you are buying

The Products are digital files, mainly in PDF format. No physical item is shipped. Product descriptions on this website are written to be as accurate as possible. Small details such as layout, photos, page count or recipe order may change as we improve the book. Any updates we release to a Product you bought are free.

3. Prices and payment

• All prices are shown in US dollars (USD) unless stated otherwise. Sales tax or VAT may be added at checkout depending on where you live.
• Payments are processed by our payment provider, Whop. When you check out, you also agree to Whop's own terms and privacy policy. We never see or store your full card details.
• Each purchase is a one-time payment. You are not signed up for a subscription and will not be charged again unless you choose to buy something else.
• Launch or sale prices may end or change at any time. A price change does not affect orders that have already been paid.
• We may refuse or cancel an order if we suspect fraud, if there is a clear pricing error, or if the purchase breaks these Terms. If we cancel a paid order, we will refund it.

4. Delivery

After your payment is confirmed, you will get access to your files through Whop, and a confirmation is sent to the email you used at checkout. Delivery is normally instant. If you haven't received access within 24 hours, check your spam folder and then contact us at emikoo091@icloud.com.

5. Refunds

Because the Products are digital and delivered immediately, all sales are final, with the exceptions described in our Refund Policy. That policy is part of these Terms.

6. Your license to use the cookbook

When you buy a Product, we give you a personal, non-exclusive, non-transferable license to download, view and print it for your own household's non-commercial use. You may:

• Keep copies on your own devices and print copies for your own kitchen.
• Cook the recipes at home and share the food with anyone you like.
• Share photos of dishes you made, and briefly mention or review the book.

You may not:

• Share, upload, resell, give away, or send the PDF (or large parts of it) to other people, including in group chats, forums, file-sharing sites or social media.
• Copy recipes, text, photos or design into your own book, course, website, app or product.
• Remove copyright notices or claim the content as your own.
• Use the content to train artificial intelligence or machine-learning models.

If you break these rules, your license ends automatically, and we may take further action to protect our work.

7. Intellectual property

All content on this website and in the Products, including text, recipes as written, photos, illustrations, designs, logos and the "Emiko" character, belongs to us or our licensors and is protected by copyright and other laws. Nothing in these Terms transfers ownership to you.

8. Health and safety disclaimer

• Talk to a doctor or registered dietitian before making big changes to your diet. This matters especially if you are pregnant or breastfeeding, have a digestive or other medical condition, or take medication. For example, some foods affect blood thinners.
• You are responsible for checking every recipe for ingredients you or the people you cook for are allergic or sensitive to, including soy, wheat, fish, sesame, nuts and dairy.
• Follow normal food safety practices when cooking, fermenting, pickling and storing food. Results depend on your ingredients, equipment and methods, and we can't guarantee them.

9. About Emiko and AI-generated content

"Emiko" is an AI-generated character used to present our content. Images of Emiko on this website, on social media and in our marketing are AI-generated. Some illustrations or images in the Products may also be created with AI tools. Food photos may be styled or illustrative, so your dish may look different.

10. Acceptable use of the website

Please don't misuse the website. That includes trying to break into it, disrupting it, scraping it in bulk, or using it for anything unlawful.

11. Third-party services and links

The website uses third-party services, including Whop (payments and delivery) and Netlify (hosting), and may link to other sites such as Instagram. We aren't responsible for those services or sites, and your use of them is covered by their own terms.

12. No warranties

The website and Products are provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the website will always be available or error-free.

13. Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any illness, injury, allergic reaction or loss that results from using the Products or recipes. Our total liability for any claim relating to the website or Products is limited to the amount you paid for the Product involved. Some places don't allow these limits, so parts of this section may not apply to you. Nothing in these Terms limits liability that can't legally be limited, and nothing affects your statutory rights as a consumer.

14. Indemnity

You agree to cover us for any claims, losses or costs (including reasonable legal fees) that result from your breach of these Terms or your misuse of the Products, such as sharing or reselling them.

15. Chargebacks

If there's a problem with your order, please contact us first. We're happy to help. If you file a chargeback for a purchase you received and used, we may dispute it and remove your access to the Products.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. The Terms in force when you made your purchase apply to that purchase.

17. Governing law

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules. If you are a consumer, you also keep any protections the law of the country where you live gives you.
